{1} In this case we determine how long and under what conditions a commercial truck may be detained at a roadside weigh station before a routine, regulatory stop ripens into an unlawful de facto arrest that may vitiate a subsequent consent to search. Because we conclude under the circumstances of this case that Defendant was unreasonably and unlawfully detained before he consented to a search of his truck, we conclude that Juttes motion to suppress should have been granted, and accordingly, we reverse the decision of the district court to the contrary.
